Here is a sampling of the contents of the rental agreement we will send to you for your agreement and signature. Of course, the one you receive will have your particular rental information, etc.
We, The Renters (herein also known as Tenants, Guests), agree to the following:
1. We will notify the owner/managers of any damage to the property immediately upon arrival.
2. We will leave the chalet reasonably clean when vacating, or an additional cleaning fee will be deducted from the deposit or debited on our credit card.
3. We will be completely responsible for any and all damage to the cabin or property caused by our negligence and will notify the owner/manager of such damage.
4. We will hold the owner/managers harmless from any and all bodily injury and/or property damage incurred on the property arising out of our negligent acts or omissions. See disclaimer below.
5. We will forfeit any portion of the security/damage deposit that is reasonably attributable to broken, damaged, or missing items, including but not limited to furniture, fixtures, amenities and DVD's.
6. We will forfeit 50% of the rental and fees, if cancellation is made less than 28 days from arrival, but at least 2 weeks before arrival. We understand the $400 deposit and cleaning fee will be returned to credit card less $75 cancellation fee and 5% Processing Fee.
7. We will forfeit the full rental and fees if reservation is canceled 14 days or less prior to arrival. No-Shows and Last Minute Cancellations forfeit full rental monies. We will receive a refund of security deposit and cleaning fee less $75 Cancellation Fee and 5% Processing Fee and the remainder will be returned to our credit card.
8. There are no refunds/discounts for late arrival or early departure.
9. There are no refunds for snow or weather conditions, car troubles/accidents, acts of God, airlines, power failures, death in my family or accidents/injuries or any other circumstance.
10. We understand all rental, deposit and fees are due 28 days prior to arrival.
11. We will forfeit 50% security/damage deposit if doors and windows are not locked upon check-out and/or key is not in lockbox. Any damage or theft resulting from open doors/windows will result in charges to my credit card.
12. We will not hold the owner/managers responsible for any items left after our check out.
13. Lost keys will incur replacement costs.
14. This is not a party house and we will not conduct parties.
15. We will not re-arrange the indoor furniture and will do our best to maintain the kitchen amenities in their original cupboards/drawers. We understand if we re-arrange the indoor furniture, we will be charged $275.
16. We understand NO SMOKING is permitted inside. If we smoke, we will light up outside and only smoke outside. If this regulation is violated and smoking has been detected in the cabin, a $275 penalty will be charged to our credit card and our security deposit will be forfeited.
17. We understand there are NO PETS allowed and we will not be bringing our pets. We understand any misrepresentation regarding pets will incur a $275 charge to our credit card and our security deposit will be forfeited. We will also be asked to leave. Rental payments, etc. and deposits will be forfeited if this occurs.
18. Maximum occupancy is 6 total - adults & children and we will not have any more than that sleeping at the cabin. However, there may be very special circumstances that we have previously discussed with owner/manager and been approved by owner/manager.
19. Check in is 4:00 PM and Check out is 11:00 AM. A late check out may be available upon request and is subject to extra rental charges.
20. Because of fire hazard, we understand the use of candles is not permitted (except citronella candles in buckets) and damage by any type of candles will result in forfeiture of deposit to cover cost of repairs and/or replacement costs. If replacement cost are over $400, we will pay the additional costs via automatic debit to our credit card or by check.
21. When using the fireplace, we will open the damper. If we fail to do so and cause excessive odor from smoke damage, we will forfeit our deposit for cleaning and deodorizing.
22. We will not create a fire pit or camp fire on the property. We will not empty ashes from charcoal grill or fireplace on the property grounds. We will be responsible, respectful and we will prevent forest fires. If we cause a fire on the property or in the home, we will call the fire department and we will notify the owner/manager immediately. We understand we will forfeit our entire deposit and may be charged additional fees for cleanup and/or repairs.
23. We understand our use of the hot tub is at our own risk. If we get rashes or any other conditions from use of the hot tub, we accept full responsibility and hold the owner/manager harmless.
24. We will not use soaps, bath oils, bubble baths, perfumes, or bath salts in the hot tub nor will we eat in the hot tub. If products and/or food are found in the hot tub after we check out, we understand there will be a charge of $150 for the additional cleaning of the hot tub.
25. We understand all policies are available on the website www.cabininasheville.com . We will observe the policies and procedures as they are in place to insure a clean and comfortable environment for us, as well as future guests. We further understand it is the responsibility of all our guests and members of our party to be familiar with all policies pertaining to rental.
26. I am 23 years of age or older.
The NAMED CABIN is privately owned and the owner reserves the right to refuse service to anyone. Guests are responsible for any accidents, injury, or loss of valuables while staying at cabin.
STORM POLICY/ROAD CONDITIONS: No refunds will be given for storms, rain, ice or snow. Mountain roads can be curvy and steep. Our roads are well maintained, however we do not refund due to road conditions. You are encouraged to buy trip insurance (link provided on our website) to cover emergencies resulting in cancellation, including weather and road conditions.
Disclaimer:
Tenants and Guests understand that the owner and Cabin In Asheville are NOT responsible for any personal injury on the property and should practice safety during hot tub use and while on the property. And further that the owner is not responsible for any personal injury or loss or damage to tenants' /guests' property caused directly or indirectly from foul, inclement weather conditions, acts of nature, failure of heat, accidents related to fire, heaters, stoves, tenants'/guests' failure to remove snow around access areas, or any unforeseeable circumstances. Under no circumstances will tenants or their guests hold the owner/manager of the cabin responsible for any damages or claims of any kind resulting from their stay including the use of the hot tub, except for intentional acts of harm.
This agreement and disclaimer applies to you and all guests within your party.
I confirm that the cancellation policy was read to me at time of rental or I indicated that I have read it. I have also read, understand, agree to, and will abide by this rental agreement/disclaimer and all conditions stated herein. By accepting this reservation, it is agreed that all guests of the registered renter are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
By signing below, I agree to the conditions on page one and two of this rental agreement. I hereby give permission to charge my credit card or withhold from my deposit the amounts indicated above. I agree that all rental monies are non-refundable per cancellation policy above. I understand my rights to purchase travel insurance.
